Resident Sues City Over Negligent Sidewalk Maintenance Leading To Severe Injury

A Lake Worth resident has filed a lawsuit against the City of West Palm Beach, alleging negligence that led to a severe injury. Monica Rolon initiated the complaint in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida, on July 15, 2024, accusing the city of failing to maintain safe conditions on its sidewalks.

According to the court documents, Rolon claims that on November 14, 2023, she tripped and fell due to an uneven sidewalk on Olive Avenue near St. Ann’s School garage in West Palm Beach. The plaintiff asserts that the cement sidewalk was raised by at least two inches, creating a hazardous condition. Rolon alleges that this unsafe condition resulted in her violent fall and subsequent serious injuries. She contends that the City of West Palm Beach had a duty to maintain its premises in a reasonably safe condition but failed to do so.

The complaint outlines several specific accusations against the city. It states that West Palm Beach negligently maintained its premises by allowing an unsafe condition to persist, thereby exposing pedestrians like Rolon to potential harm. The plaintiff argues that the city failed to monitor, inspect, and repair the dangerous sidewalk despite knowing or having reason to know about its hazardous state. Additionally, Rolon accuses the city of not providing adequate warnings about the dangerous condition or offering alternative ways to avoid it.

Rolon's attorney emphasizes that all conditions precedent for bringing this cause of action have been met or waived. The plaintiff is seeking damages exceeding $50,000 for medical expenses, physical and mental pain and suffering, limitations on her usual activities and recreations, and her inability to lead a normal life due to her injuries.
