Palm Beach Resident Sues Walmart Over Negligence Leading To Severe Injuries

A Palm Beach County resident has filed a lawsuit against a major retail chain, alleging negligence that led to severe injuries. On July 15, 2024, Lidiane Kiernan filed a complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, against Wal-Mart Stores East, LP and its store manager Landon Moore.

According to the complaint, Kiernan claims that on May 11, 2024, she was shopping at Walmart Supercenter #1541 located at 9990 Belvedere Road in West Palm Beach when she slipped and fell due to a puddle of water on the floor in the produce department. Kiernan alleges that Walmart and Moore failed to maintain the premises in a reasonably safe condition and did not warn her of the dangerous condition. The plaintiff asserts that this negligence directly resulted in her suffering severe and permanent injuries.

The lawsuit details multiple counts of negligence against both defendants. Kiernan accuses Walmart of failing to exercise reasonable care for her safety by allowing hazardous conditions to exist on their premises. She further claims that Walmart neglected to implement proper policies and procedures for routine inspections that could have identified and remedied such hazards. Specifically, Kiernan states that Walmart "negligently and carelessly permitted" her to walk upon unsafe premises without adequate warning or protective measures.

In addition to holding Walmart accountable, Kiernan also targets Landon Moore individually as well as in his capacity as store manager. The complaint asserts that Moore was responsible for ensuring employee compliance with safety protocols and conducting regular inspections of the store's premises. Kiernan argues that Moore's failure to fulfill these duties contributed significantly to her accident and subsequent injuries.

Kiernan is seeking judgment for damages exceeding $50,000 from both defendants. She requests compensation for physical pain and suffering, medical expenses, loss of earnings, and other related costs incurred due to her injuries. Additionally, she demands prejudgment interest and any other relief deemed appropriate by the court.
