A Palm Beach County resident is seeking justice after a dog attack left her with significant injuries. On July 11, 2024, Cynthia Mancha filed a complaint in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida, against Suraj Tamara.
According to the complaint, Mancha was walking her dog on May 5, 2024, when she encountered a broken fence at Tamara's property located at 3566 Ivanhoe Ave, Boynton Beach. The broken fence allowed a pit bull-looking dog to charge at Mancha, causing her to trip and fall. As a result of this incident, Mancha sustained severe injuries. The plaintiff claims that there were no warnings about the broken fence or the potential danger posed by the dog.
Mancha alleges that Tamara had a duty to maintain his property and ensure it was safe for people. She accuses him of negligence for failing to inspect and repair the fence properly. "The dangerous condition was either known to Suraj Tamara or had existed for a sufficient length of time so that Suraj Tamara should have known of it," states the complaint. Specific allegations include failure to inspect and maintain the fence safely, lack of appropriate policies and procedures for inspection and maintenance, failure to warn about the damaged fence, and non-compliance with applicable safety codes.
As a direct result of Tamara's alleged negligence, Mancha claims she has suffered permanent bodily injury leading to pain and suffering, disability, scarring, mental anguish, loss of capacity for enjoyment of life, and medical expenses. These losses are described as either permanent or continuing.
Mancha is seeking damages exceeding $50,000 along with costs and interest. She also demands a trial by jury to resolve this matter.
