Visitor Sues Local Diner Over Negligence Leading to Injury

A local diner is facing serious allegations after a visitor suffered injuries on its premises. Pauline Walter filed a complaint against Trip’s MLK, LLC in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on June 24, 2024.

According to the complaint, Walter claims that on December 14, 2023, she visited the property located at 2339 Dr. M.L.K. Jr St N in St. Petersburg as an invitee when she tripped and fell due to a negligently placed and unanchored bicycle rack. The lawsuit asserts that Trip’s MLK, LLC failed to maintain safe conditions on their property, which led to her accident and subsequent injuries.

The plaintiff's complaint outlines several accusations against Trip’s MLK, LLC. It alleges that the defendant "negligently maintained the properties so that they were in a state of neglect," creating dangerous conditions for visitors like Walter. Specifically, it points out that the defendant did not reasonably inspect or correct unsafe conditions and failed to warn visitors about these hazards. As a result of this negligence, Walter experienced significant physical and emotional distress including bodily injury, pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, medical expenses, loss of earnings and earning capacity, and aggravation of pre-existing conditions.

Walter seeks damages exceeding $50,001 from Trip’s MLK LLC for her injuries and demands a trial by jury to determine the fair value of her claim. She is represented by Barbara L. Walsh from Viles & Beckman LLC based in Fort Myers.
