A shocking incident has led to a lawsuit that highlights the critical importance of property maintenance and safety protocols. Jessie Williams has filed a complaint against Infuserve America, Inc. and Kazarian Realty, LLC in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida on June 28, 2024.
The case revolves around an accident that occurred on December 15, 2023. Jessie Williams, an independent contractor, was on the premises of Infuserve America located at 11880 28th Street #200 in St. Petersburg to pick up a delivery. When she pressed the button for a lift and stepped inside as the door opened, she fell 16 feet due to what she claims was a hazardous condition. This fall resulted in severe injuries including pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, medical expenses, and loss of earnings.
Williams' complaint accuses both defendants—Infuserve America and Kazarian Realty—of negligence. The lawsuit alleges that Kazarian Realty LLC failed to properly maintain their property and did not regularly inspect it to ensure it was safe for invitees like Williams. "Defendant permitted a hazardous lift without sufficient warning of the danger posed," states one part of the complaint. Similarly, Infuserve America is accused of failing to take necessary steps to secure potentially dangerous areas within their pharmacy.
Williams is seeking damages exceeding $50,000 from each defendant along with interest and costs. She also demands a jury trial for all issues so triable. The plaintiff argues that both companies had clear duties to maintain their premises safely but breached these duties by allowing dangerous conditions to exist without adequate warnings.
