A slip-and-fall incident at a popular restaurant has led to a significant legal battle. On June 28, 2024, Matthew Eva filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Yard House USA, Inc., seeking damages exceeding $50,000.

According to the complaint filed by Eva, he visited the Yard House location at 11701 Lake Victoria Gardens Ave in Palm Beach on January 12, 2024. During his visit as a business invitee and guest, Eva alleges that he slipped and fell due to a slippery substance on the floor. The fall resulted in bodily injury and subsequent suffering for Eva. The plaintiff asserts that Yard House USA had a non-delegable duty to maintain its premises in a reasonably safe condition for patrons but failed to do so.

The lawsuit outlines several allegations against Yard House USA. Eva claims that the restaurant negligently failed to maintain its flooring adequately, creating an unreasonably dangerous condition for guests. Specific accusations include failing to inspect or warn about the hazardous floor conditions, not correcting or maintaining the flooring properly, and inadequately training employees regarding safety protocols. "Negligently failing to follow its own corporate policies regarding dangerous conditions" is one of the critical points raised by Eva's legal team.

Eva's injuries from the fall are described as significant and permanent. He details suffering from physical pain and mental anguish, disability, disfigurement, loss of enjoyment of life, medical expenses, and lost earnings both past and future. The plaintiff seeks compensatory damages beyond the minimum jurisdictional limits of the court for these losses.

Representing Matthew Eva is Jessica Orenstein from Morgan & Morgan P.A., the case ID is: 502024CA006095XXXAMB Div: AO.
