Plaintiff accuses rehabilitation center and medical facility of gross negligence leading to severe injuries

A shocking case of alleged medical negligence has surfaced in Palm Beach County, Florida. On June 14, 2024, Kimberly Ann Begovich-Ahearn filed a complaint in the Fifteenth Judicial Circuit Court against Nuvista Living at Jupiter, LLC, doing business as The Luxe at Jupiter Rehabilitation Center, and Jupiter Medical Center, Inc., doing business as Jupiter Medical Center.

The lawsuit was initiated by Kimberly Ann Begovich-Ahearn on behalf of her mother, Patricia Gail Begovich. The complaint details a series of events starting from July 2, 2022, when Patricia was admitted to Jupiter Medical Center for treatment of a human metapneumovirus infection. During her stay at the hospital, Patricia became weak and incontinent of bowel and developed a sacral pressure injury. Upon her discharge on July 21, 2022, she was transferred to The Luxe at Jupiter Rehabilitation Center where her condition deteriorated further into a Stage 4 ulcer.

According to the complaint, both medical facilities are accused of providing substandard care that resulted in significant bodily injuries and pain for Patricia. Kimberly alleges that while under the care of these institutions, Patricia suffered from negligence that led to severe physical and emotional distress. "Defendant's breach of duties owed to the patient was the legal cause of injury and damages suffered," reads one part of the filing.

Kimberly asserts that both facilities failed in multiple areas: developing an appropriate care plan for Patricia’s condition; adequately assessing and monitoring her skin status; implementing necessary interventions; responding to high-risk conditions; executing physician orders; and overall failure in providing a safe environment free from abuse and neglect. These failures are said to have exacerbated Patricia's condition significantly.

The plaintiff is seeking damages exceeding $50,001 exclusive of costs and interest. The types of relief sought include compensation for bodily injury, physical impairment, mental anguish, loss of capacity to enjoy life, medical expenses incurred due to negligent acts by both defendants.
