A recent court filing has brought to light a significant negligence case involving a prominent hotel in West Palm Beach. On June 11, 2024, Deanne Katsaros filed a complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, against WS BPB Owner LLC, doing business as The Ben West Palm Beach, and an unnamed hotel manager referred to as John Doe.

According to the complaint, on February 23, 2021, Deanne Katsaros visited The Ben West Palm Beach as a guest. During her stay, she alleges that she was injured due to a broken patio furniture table in her hotel room. Katsaros claims that the defendants failed to maintain the premises safely and neglected their duty to warn her of any dangerous conditions. "The defendant owed Plaintiff duties to maintain the premises in a reasonably safe condition and to warn Plaintiff of dangerous conditions on their premises," states the complaint.

Katsaros accuses WS BPB Owner LLC of multiple counts of negligence. She asserts that the company did not adequately inspect or maintain the patio furniture table, creating an unreasonably dangerous condition. The lawsuit details various ways in which the hotel allegedly failed its responsibilities: "Negligently failing to maintain or adequately maintain the hotel room patio furniture table... Negligently failing to inspect or adequately inspect... Negligently failing to correct and/or replace the unreasonably dangerous condition." These failures purportedly led to Katsaros suffering bodily injury resulting in pain and suffering, disability, disfigurement, permanent scarring, mental anguish, loss of enjoyment of life, medical expenses, and loss of earnings.

In addition to suing WS BPB Owner LLC under premises liability and negligence doctrines, Katsaros also brings charges against John Doe. As a hotel manager responsible for daily operations and ensuring safety standards were met at The Ben West Palm Beach, John Doe is accused of personal negligence. The complaint highlights his direct involvement: "Defendant JOHN DOE was directly responsible for maintaining and operating the hotel... personally involved in WS BPB OWNER LLC D/B/A BEN WEST PALM BEACH’s previously described tortious conduct."

Katsaros seeks damages exceeding $50,000 from both defendants for her injuries and associated losses. She demands judgment plus interest and costs and requests a jury trial for all triable issues.

Representing Deanne Katsaros is attorney Travis J. Stulz from Weinstein Legal Team based in Orlando. The case number is 502024CA005462XXXAMB.
