A Florida resident has filed a lawsuit against a couple, alleging negligence after suffering significant injuries on their vacation rental property. Carol Bauer filed the complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on June 11, 2024, naming Frank Bonifacio and Michele Bonifacio as defendants.
According to the complaint, Bauer visited the Bonifacios' property at 320 Bahia Vista Drive, Indian Rocks Beach, on September 22, 2022. The property was advertised as a vacation rental and open to business invitees and guests. During her stay, Bauer fell while exiting through a rear sliding glass door due to an unmarked step that blended with the patio pavers, creating an optical illusion. This fall resulted in severe personal injuries for Bauer.
The plaintiff claims that both Frank and Michele Bonifacio breached their duty to maintain a safe environment for guests. The complaint details several alleged failures by the defendants: neglecting to maintain or adequately inspect the step leading to the backyard deck; failing to warn guests about the dangerous condition; and not taking reasonable steps to correct or replace the hazardous step. These actions are cited as direct causes of Bauer's injuries which include pain and suffering, disability, disfigurement, permanent scarring, loss of enjoyment of life, medical expenses, and aggravation of pre-existing conditions.
Bauer is seeking damages exceeding $50,000 from each defendant along with interest and costs. She also demands a jury trial for all triable issues. Her attorney Nathan E. Wittman from Colling Gilbert Wright law firm submitted the filing.
Judge Ken Burke will preside over this case under Case Number 24-002604-CI.
