Plaintiff Alleges Negligence and Breach of Contract Against Driver and Insurer

A recent court filing in Pinellas County, Florida, has brought to light a serious car accident involving allegations of negligence and breach of insurance contract. The complaint was filed by Kayla Rodriguez on June 8, 2024, against Amanda Walker and Progressive Select Insurance Company.

According to the court documents, Kayla Rodriguez claims that on August 12, 2022, Amanda Walker negligently operated her 2020 Chevrolet in Seminole, Pinellas County, resulting in a collision with Rodriguez's vehicle. The plaintiff alleges that Walker's reckless driving caused significant bodily injuries and substantial financial losses. Rodriguez is seeking damages exceeding $50,000 for medical expenses, pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, and other related costs.

Rodriguez's lawsuit also targets Progressive Select Insurance Company for failing to honor an uninsured/underinsured motorist policy issued to her. She asserts that despite fulfilling all policy obligations and conditions precedent to the claim, Progressive has refused to pay the benefits owed under the policy. The insurance company’s alleged breach has compounded Rodriguez's difficulties following the accident.

The plaintiff is demanding a jury trial and seeks judgment for damages from both defendants. Represented by attorney Cord Grimes of Kemp Law Group, Rodriguez hopes the court will grant relief appropriate under the circumstances.

The case is presided over by Judge Ken Burke under Case Number 24-002558-CI.
