A local resident has taken legal action against a Florida corporation, alleging negligence that led to severe personal injuries. Danillia Williams filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on June 4, 2024, against Diego Lozano and Ann Underground, Inc.
The lawsuit stems from an incident on June 18, 2022, when Williams claims she slipped and fell due to hazardous conditions at her residence. According to the complaint, Ann Underground, Inc., owned by Diego Lozano, was responsible for installing telecommunications lines at Williams' home located at 1383 The 12th Fairway in Wellington, FL. The installation allegedly blocked the drainage system of her home, leading to water accumulation on the floor. This hazardous condition caused Williams to slip and fall within her residence.
Williams asserts that Diego Lozano and Ann Underground, Inc., had a duty to ensure that their work did not create dangerous conditions. The complaint details multiple instances of alleged negligence: failing to install telecommunications lines without obstructing the drain line; neglecting to place warning signs or cones around debris; not taking corrective actions to maintain safe floor conditions; inadequately training employees; and failing to inspect the area properly. "Defendant's duties are non-delegable," states the complaint.
As a result of this alleged negligence, Williams suffered significant injuries including bodily harm, pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses for hospitalization and nursing care, loss of earnings and earning capacity. These damages are described as either permanent or continuing in nature.
Williams is seeking compensatory damages exceeding $30,000 along with taxable costs and prejudgment interest. She demands a jury trial for all issues so triable. Additionally, she holds Diego Lozano and Ann Underground Inc., vicariously liable for the negligent acts committed by their agents or employees during the installation process.
