In a recent court filing, Bianca Martino has lodged a civil complaint against Noire The Nail Bar at Tyrone Square Mall, LLC, a Florida Limited Liability Company. The complaint was filed on May 31, 2024, in the Sixth Judicial Circuit in and for Pinellas County, Florida.
According to the lawsuit, Bianca Martino claims that she sustained severe injuries after receiving pedicure services at Noire The Nail Bar located at 6779 22nd Avenue North in St. Petersburg on September 6, 2023. Martino alleges that the nail salon failed to maintain proper sanitation of its equipment, which led to her contracting a severe infection. The complaint asserts that the defendant had both actual and constructive knowledge of the dangerous condition created by their failure to properly sanitize and care for their equipment.
The plaintiff's legal representation states that Noire The Nail Bar had a non-delegable duty to ensure the safety and sanitation of their equipment but neglected this responsibility. "Defendant created a dangerous condition by failing to maintain appropriate sanitization and care of equipment used for pedicure services," reads the complaint. It further details that the infection progressed throughout Martino's body, necessitating multiple hospitalizations.
Martino is seeking damages exceeding $50,000 exclusive of interest and costs. She claims ongoing pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, inconvenience, medical expenses, and loss of earnings as direct consequences of the incident. The plaintiff demands judgment for damages against Noire The Nail Bar along with costs associated with the action and requests a trial by jury.
