Plaintiff Alleges FCA US LLC Breached Warranty on Defective Vehicle

**Pedro Alves-Dearaujo Files Breach of Warranty Complaint Against FCA US LLC**

On May 22, 2024, Pedro Alves-Dearaujo filed a complaint against FCA US LLC in the Circuit Court for Palm Beach County, Florida. The filing accuses FCA US LLC of breaching its written warranty under the Magnuson-Moss Warranty Act.

The case centers around a 2022 Jeep Wrangler Unlimited that Alves-Dearaujo leased from Napleton Chrysler Dodge Jeep on February 18, 2022. The vehicle, manufactured and distributed by FCA US LLC, was sold with a written warranty promising three years or 36,000 miles of bumper-to-bumper coverage and five years or 60,000 miles of powertrain coverage. Despite these assurances, Alves-Dearaujo claims that the vehicle exhibited significant defects shortly after he took possession.

According to the complaint, the Jeep Wrangler experienced various mechanical issues that impaired its use and safety. Specifically, Alves-Dearaujo cited problems with the engine and electrical system as evidenced by an illuminated check engine light. He alleges that despite multiple repair attempts by authorized dealers within FCA's network, the issues remained unresolved.

"Manufacturer was unable and/or failed to adequately repair the defects in Plaintiff's Wrangler as provided in Manufacturer's warranty," states the complaint. Alves-Dearaujo argues that this failure has substantially impaired his confidence in the vehicle’s safety and reliability.

Alves-Dearaujo also contends that FCA US LLC engaged in misleading advertising practices to induce consumers to purchase their vehicles from authorized dealerships. He asserts that FCA's aggressive marketing campaigns falsely assured buyers of the reliability and quality of their products.

The plaintiff is seeking damages exceeding $50,000 for breach of warranty under both state law (F.S.A. § 672.719(2)) and federal law (15 U.S.C. § 2310(e)). Additionally, he is asking for compensation for incidental and consequential damages incurred due to the vehicle’s defects. Alves-Dearaujo also seeks reasonable attorney fees and court costs.
