Kathryn Ann Mihalek has filed a negligence complaint against Octapharma USA Inc. and 3365 Central Property Owner LLC. The lawsuit was filed in the Circuit Court for the Sixth Judicial Circuit in Pinellas County, Florida, on May 22, 2024.
According to the court documents, Mihalek alleges that on April 25, 2023, she visited the property located at 3365 Central Ave, St. Petersburg, FL 33713 as a business invitee of Octapharma USA Inc. The property is owned and controlled by 3365 Central Property Owner LLC. Mihalek claims that both defendants negligently maintained the premises by allowing unsafe floor mats to remain on the property, creating a defective and dangerous condition unknown to her.
The complaint states that due to this negligence, Mihalek slipped and fell over the defective mats, resulting in bodily injury and subsequent pain and suffering. She further asserts that this incident led to disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, inconvenience, expenses related to hospitalization and medical care, loss of earnings, loss of ability to earn money, and aggravation of a pre-existing condition.
Mihalek contends that both Octapharma USA Inc. and 3365 Central Property Owner LLC had a duty to maintain the property in a reasonably safe condition but failed to do so or warn her about the dangerous condition. As a result of their alleged breach of duty, she suffered significant injuries and damages.
In her lawsuit, Mihalek seeks judgment for damages exceeding $50,000 exclusive of costs against both defendants. She is also requesting any other relief deemed appropriate by the court under the circumstances.
