Plaintiff sues Guanabanas Restaurant over negligence leading to injuries

Victoria Carney has filed a negligence complaint against Guanabanas Restaurant, Inc., 960 AlA LLC, and Florida Preferred Service, LLC. The lawsuit was filed in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida on May 22, 2024.

The plaintiff, Victoria Carney, alleges that she sustained significant injuries due to the negligence of the defendants. On May 25, 2020, Carney was a guest at Guanabanas Restaurant located at 960 N. Highway A1A in Jupiter, Florida. According to the complaint, a fabric tarp installed above the valet station at the restaurant collected rainwater and subsequently detached from its fixtures, collapsing onto Carney and causing her serious injuries.

Carney's lawsuit details several allegations against each defendant. She claims that Guanabanas Restaurant failed to maintain its premises in a safe condition and did not warn patrons about the hazardous condition of the tarp. The complaint states that "the Defendant had actual knowledge or should have known with reasonable care and investigation that the fabric tarp cover could collect rainwater, detach from its fixtures and collapse." Furthermore, it accuses Guanabanas of failing to properly install and inspect the tarp.

Similarly, 960 AlA LLC is accused of negligence for owning and managing the property where Guanabanas Restaurant is located. The company allegedly failed to ensure that their property was safe for business invitees like Carney. They are also accused of failing to notify other defendants about the dangerous condition presented by the fabric tarp covering.

Florida Preferred Service, LLC is also named as a defendant because they operated a valet car parking service at Guanabanas Restaurant. The complaint alleges that Florida Preferred Service failed to maintain their valet station area safely and did not adequately warn patrons about potential hazards posed by the fabric tarp cover.

Carney seeks compensatory damages exceeding $50,000 from each defendant for her injuries which include pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, aggravation of pre-existing conditions as well as medical expenses.
