Man sues ARHC ALTSPFLO1 TRS LLC and KR Management L.L.C for Negligence Leading to Mother's Death

Brian McGinnis, as the Personal Representative of the Estate of Florence M. McGinnis, has filed a lawsuit against ARHC ALTSPFLO1 TRS, LLC and KR Management, L.L.C. in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida (Case No. 24-002098-CI) on May 13, 2024. The lawsuit alleges negligence and wrongful death due to inadequate care provided to Florence M. McGinnis at Addington Place of East Lake, an assisted living facility owned by ARHC and managed by KR.

According to the complaint filed by attorney Stephen H. Haskins from Lucas, Macyszyn & Dyer, Florence M. McGinnis experienced multiple falls while residing at Addington Place, with a significant fall occurring on September 15, 2021. Despite her deteriorating condition and previous falls, no additional safety measures were implemented by the facility staff. As a result of this neglect, Ms. McGinnis suffered severe injuries leading to her hospitalization and subsequent death on September 22, 2021.

The plaintiff claims that ARHC and KR failed to provide adequate care and violated resident rights under Florida Statutes Section 429.28. Damages sought include compensation for medical expenses, funeral costs, lost parental companionship for surviving children Brian McGinnis, Mark McGinnis, James McGinnis, Kathy McGinnis, Raymond McGinnis, Lisa Basti (also known as Lisa McGinnis), and Jeffrey McGinnis.

Brian McGinnis is seeking judgment for damages exceeding $50,000 against both defendants for their alleged negligence resulting in Florence M. McGinnis' suffering and eventual death.
