Estate sues nursing home entities over alleged negligence leading to resident's death

The Estate of Marilyn Koss, represented by Cynthia J. Mairs, has filed a lawsuit against CCRC Opco Freedom Square, LLC; Life Care Services, LLC; Healthpeak Properties, Inc.; and Allison Beck Chavez in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida (Case No. 24-002133-CI). The suit was e-filed on May 14, 2024, and alleges negligence and wrongful death during Koss's stay at Freedom Square Health Care Center.

Marilyn Koss was admitted to Freedom Square Health Care Center on June 15, 2022, and remained there until her discharge on January 26, 2023. The plaintiff's lawyer is Lydia D. Wardell from Wilkes & Associates, PA. The complaint details multiple failures by the defendants to provide adequate care resulting in numerous injuries and infections for Koss.

The estate seeks damages exceeding $50,000 for non-lethal negligence including pain and suffering experienced by Koss before her death on February 5, 2023. They also seek survival damages for lethal negligence leading to her death as well as wrongful death damages covering medical expenses and loss of companionship for her surviving child.

Plaintiff demands judgment against the defendants for compensatory damages along with attorney fees and costs. They also request a jury trial and reserve the right to amend the complaint to include punitive damages.
