Woman sues Chick-Fil-A for negligence after tripping on handicap ramp

Beatriz Romero has filed a lawsuit against Bill Fink, doing business as Chick-Fil-A, Inc., and Jane Doe in the Circuit Court of the 6th Judicial Circuit in Pinellas County, Florida. The case number is 24-002087-CI, and it was e-filed on May 13, 2024. The lawsuit concerns premises liability and negligence following an incident where Romero sustained injuries at a Chick-Fil-A location.

According to the complaint, Romero visited the Chick-Fil-A at 3740 Tampa Road, Oldsmar, Florida on November 27, 2023. While exiting the restaurant with her food and special needs child, she tripped over an uneven section of a handicap ramp near the drive-through lane. As a result of this fall, Romero suffered significant personal injuries including pain and suffering, disability, disfigurement, mental anguish, and medical expenses.

Romero's attorney Blake R. Carl from Morgan & Morgan P.A., alleges that both defendants had either actual or constructive knowledge of the hazardous condition but failed to take appropriate actions to rectify it. The lawsuit claims damages exceeding $50,000 exclusive of costs and interest. The plaintiff seeks judgment for these damages plus interest and costs while demanding a jury trial.

Romero is seeking compensation for bodily injury resulting in pain and suffering, permanent scarring, loss of earning capacity among other losses. She argues that these damages are either permanent or continuing and will affect her future quality of life.
