Man sues two men for negligence in car accident

In the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, Timothy Wayne Gerbers has filed a lawsuit against John Ryan Spinella and John Spinella. The case, identified as 24-002101-CI, was e-filed on May 13, 2024. The lawsuit concerns a motor vehicle accident that occurred on November 30, 2022, in Clearwater, Pinellas County.

According to the complaint filed by Gerbers' attorneys Gregory J. Perenich and Miriam J. Fisher of Perenich Law, PL, the incident involved John Ryan Spinella operating a vehicle owned by John Spinella. Gerbers alleges that John Ryan Spinella negligently drove his vehicle into Gerbers' car causing serious injuries. The plaintiff claims damages exceeding $50,000 exclusive of costs.

Gerbers asserts that due to the negligence of John Ryan Spinella, he suffered permanent injuries including bodily harm, pain and suffering, mental anguish, and loss of earning capacity among other damages. He also claims expenses related to medical care and rehabilitation.

The plaintiff seeks a jury trial and judgment against both defendants for an amount exceeding $50,000 plus attorney fees and costs. Additionally, he holds John Spinella vicariously liable under Florida's dangerous instrumentality doctrine for allowing his vehicle to be operated negligently by John Ryan Spinella.
