Man sues Mariposa for negligence leading to mother's death

Scott Petak, as the personal representative of the estate of Joyce Petak, has filed a lawsuit against BRP SH OPCO, LLC, doing business as Mariposa. The case, filed in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida (Case No. 502024CA004249XXXAMB), was electronically submitted on May 8, 2024.

The complaint alleges that Joyce Petak, an elderly resident requiring heightened nursing care and supervision, was admitted to Mariposa despite the facility's inability to provide appropriate care. As a result of inadequate care and monitoring by Mariposa’s staff, Joyce Petak developed and deteriorated into respiratory failure before her death on February 25, 2022. The plaintiff claims that Mariposa violated Florida Statute §429 regarding residents' rights in assisted living facilities. Allegations include failure to supervise properly, inadequate health care provision, and neglect leading to significant suffering and eventual death. Damages sought exceed $50,000 exclusive of interest and costs.

Scott Petak seeks compensatory damages for loss of dignity, pain and suffering endured by Joyce Petak due to negligence. He also demands recovery for medical expenses incurred and potential future losses for surviving family members.
