Guardian sues Tarpon Rehabilitation Center for alleged negligence leading to preventable injuries

In the Circuit Court of the 6th Judicial Circuit, Pinellas County, Florida, a lawsuit has been filed by Louis Vicario, guardian to Tammy Vicario against Tarpon Rehabilitation Center, LLC. The case ID is 24-001922-CI and was filed on May 1st, 2024. The lawsuit alleges that the defendant failed to provide reasonable care to Tammy Vicario during her stay at their nursing home facility resulting in preventable injuries.

The plaintiff's lawyer asserts that all conditions precedent to the filing of this action have been met or waived. It is alleged that while residing at the defendant's nursing home located in Pinellas County, Florida, Tammy Vicario suffered from preventable injuries including but not limited to skin breakdown, falls, wandering, infection, malnutrition and dehydration due to negligence on part of the facility staff.

Furthermore, it is claimed that despite being vulnerable and unable to care for herself due to ongoing medical conditions and cognitive changes, she did not receive adequate supervision and assistance from the facility staff which resulted in a bowel blockage among other injuries. The damages sought exceed Fifty Thousand Dollars ($50,000), exclusive of costs, interest and attorney’s fees.

The plaintiff seeks judgment against Tarpon Rehabilitation Center for their alleged negligence and violations of Chapter 400 while Tammy Vicario was a resident at their nursing home. They are seeking damages for the preventable injuries caused due to lack of reasonable care provided by the defendant's staff.
