Scott Levine sues National Cityplace Corp. for negligence leading to bodily injury

Scott Levine has filed a lawsuit against National Cityplace Corp., a Florida profit corporation doing business as City Cellar Wine Bar & Grill, in the Circuit Court for the 15th Judicial Circuit in Palm Beach County, Florida. The case, identified by the number 502024CA003786XXXAMB Div: AK, was filed on April 24, 2024. The plaintiff alleges that due to the defendant's negligence, he suffered damages exceeding $50,000.

Represented by attorney Michael C. Peckham of Schwed, Adams & McGinley, P.A., Levine claims that while he was lawfully on the premises of City Cellar on November 19, 2023, a chair provided by the defendant collapsed causing him to fall forcefully to the ground. This incident occurred at the defendant's bar and restaurant located at 700 South Rosemary Avenue in West Palm Beach.

Levine alleges that City Cellar failed to maintain its premises in a reasonably safe condition and did not inspect or repair defective chairs. He also claims that the defendant had actual or constructive notice of this dangerous condition but failed to warn its customers. As a direct result of this negligence, Levine suffered bodily injury leading to pain and suffering, disability, disfigurement, mental anguish among other losses.

The plaintiff is seeking judgment for damages against City Cellar and demands trial by jury on all issues so triable.
