Lieutenant Colonel Lee A. Chrostowski sues Dan Karcher Construction for construction defects

In the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, Lieutenant Colonel Lee A. Chrostowski (USMC, Retired) has filed a lawsuit against Dan Karcher Construction, Inc., and Danny L. Karcher on March 28, 2024, under case number 24-001422-CI. The plaintiff alleges that the defendants failed to rectify construction defects in a property built by them.
The dispute arises from a contract signed on May 13, 2020, where Karcher Construction agreed to construct a two-story residence with a detached garage for LtCol Chrostowski at the cost of $1,341,645.00. The total contract price increased to $1,466,891.00 due to change orders numbered one through sixty.
Chrostowski alleges that he discovered serious defects in the project and notified Karcher Construction of these issues. Despite his requests for rectification, Karcher Construction allegedly refused to address these problems and threatened to cease all further work if payment was not made.
LtCol Chrostowski is seeking damages in excess of fifty thousand dollars ($50,000), exclusive of interest, attorney’s fees and costs. He claims that he has complied with all conditions precedent to the maintenance of this action.
