Traci Slater sues Banyan Boca FL Management LLC for negligence leading to wrongful death

In the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, Traci Slater, as Personal Representative of the Estate of Lila Hirsch, filed a lawsuit against Banyan Boca FL Management LLC (doing business as Banyan Place Boca) on March 29, 2024. The case number is 502024CA002941 XXXAMB Div: AH. The complaint seeks damages exceeding $50,000 for alleged negligence resulting in the wrongful death of Lila Hirsch.

The plaintiff alleges that Lila Hirsch was a resident at Banyan Place Boca, an assisted living facility owned and operated by the defendant. At the time of her residency, Hirsch was over sixty-five years old and impaired in her ability to adequately provide for her own care due to aging. According to the filing, she passed away on June 12, 2023.

The complaint further states that during Hirsch's residency at Banyan Place Boca, the staff failed to develop an adequate care plan and negligently allowed for the development of severe wounds or ulcers on Hirsch. These injuries allegedly led to catastrophic outcomes including a leg amputation and multiple surgeries. The plaintiff asserts that these injuries directly resulted in Hirsch's wrongful death.

Slater is seeking judgment for damages which exceed fifty thousand dollars ($50,000), exclusive of interest and costs. The lawsuit alleges violation of Florida Statute Section 429 pertaining to resident rights and common law negligence. Slater has reportedly complied with all pre-suit provisions set forth in Florida Statute Section 429.293.
