The plaintiff, Rousos, alleges that he suffered significant personal injuries due to a collision with a trailer being towed by a 2017 Chevy Silverado driven by defendant Palermo. The incident occurred on June 15, 2023, when Palermo attempted to make a right turn from the middle lane into a Burger King parking lot on Park Boulevard in Pinellas County. The vehicle was owned by the second defendant, Spagnoli.
Rousos claims that Palermo breached his duty of reasonable care by failing to pay attention to road and traffic conditions, maintain a safe distance from other vehicles, keep a proper lookout, take measures to avoid colliding with other vehicles around him, obey traffic laws and use due care. As a result of these alleged breaches of duty and negligence on part of Palermo, Rousos claims to have sustained severe bodily injuries and incurred damages including bodily injury; physical and mental pain and suffering; disability; physical impairment; disfigurement; mental anguish; loss of capacity for enjoyment of life; aggravation of pre-existing condition; medical expenses; loss of earnings and loss of earning capacity.
In his complaint, Rousos is seeking judgment in excess of $50,000 against Palermo which includes costs related to court proceedings. He has also demanded a trial by jury for all issues so triable.
