Melissa Celeste Jenkins sues Tallahassee Memorial Healthcare Inc. for retaliation and violation of civil rights

In the Circuit Court of the Second Judicial Circuit, Leon County, Florida, Melissa Celeste Jenkins has filed a lawsuit against Tallahassee Memorial Healthcare Inc. The case, bearing ID 24-CA-2024 CA 000467, was filed on March 20, 2024. Jenkins is suing her former employer under the Florida Civil Rights Act, Florida’s Workers’ Compensation Law and the Family and Medical Leave Act (FMLA) of 1993.

The plaintiff alleges that she faced retaliation after reporting unlawful employment practices by the defendant and seeking benefits for an on-the-job injury sustained on June 28, 2021. Jenkins was employed by Tallahassee Memorial Healthcare Inc. from December 28, 2015 until her constructive termination on January 13, 2023.

Jenkins claims that despite her stellar work performance, she was subjected to disparate treatment due to her disability and after reporting an on-the-job injury. The alleged retaliation involved Director Mary Canova, Assistant Nurse Manager Joanna Fato, Assistant Nurse Manager Brittany Sims and Chief of Employee Health and Human Resources Steve Hanes.

Jenkins is seeking damages in excess of $50,000 exclusive of costs and interest for the violation of her rights under the aforementioned laws.
