Joseph F. Doner II sues Polestar Automotive USA Inc. for vehicle performance issues and warranty breaches

In the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, plaintiff Joseph F. Doner II has filed a lawsuit against Polestar Automotive USA Inc., with the case number 24-001111-Cl on March 8, 2024. The lawsuit is centered around alleged vehicle performance issues and warranty breaches.

The plaintiff, represented by Lemon Law Group Partners PLC, alleges that after purchasing a used 2021 Polestar Model 2 for approximately $70,440.80 on August 27, 2022, he began experiencing performance problems with the vehicle. Over a period from September 1, 2022 to January 10, 2024, Doner claims to have returned the vehicle for repairs at least six times resulting in about ninety days out of service.

Doner's complaint also highlights that as part of his purchase, he received an express warranty from Polestar which included the remaining balance of Manufacturer’s four-year/50,000-mile warranty. However, he asserts that Polestar breached this contract by failing to perform or negligently performing acts required by the contract.

The plaintiff is seeking judgment against Polestar Automotive USA Inc., claiming damages exceeding fifty thousand dollars ($50,000) exclusive of attorney’s fees, interest and costs.
