SP Lauderdale sues Tracy Totten for unpaid services

SP Lauderdale, LLC, doing business as ServPro of Ft. Lauderdale South, has filed a lawsuit against Tracy Totten in the County Court of Pinellas County, Florida. The case number is 24-002006-CO and was filed on March 5, 2024. The plaintiff alleges that Totten has failed to pay for services rendered and is seeking damages within the jurisdictional requirements of the court.

The complaint states that ServPro, represented by its counsel, provided water remediation, mitigation, and other related improvements and services at a property owned by Totten in Pinellas County. These services were carried out between September 7 and September 18, 2023. The total value of the services performed amounted to $20,218.65 with an outstanding principal balance of $15,068.65.

ServPro claims to have recorded a Claim of Lien on November 21, 2023, within the required timeframe following the provision of services. However, despite demands for payment and adherence to legal requirements including timely service of lien documents and contractor’s final affidavit upon Totten, the defendant has allegedly failed or refused to pay.

In conclusion, ServPro is seeking judgment for the unpaid principal balance along with interest, court costs and reasonable attorney's fees from Totten.
