In the Circuit Court of the Second Judicial Circuit, Leon County, Florida, a lawsuit has been filed by plaintiff Daphne Thomas against the Department of Environmental Protection. The case ID is 24-CA-2024 CA 000437 and was filed on March 14, 2024.

The plaintiff alleges that she has been subjected to disparate treatment and retaliation due to her disability and an on-the-job injury sustained in February 2014. The defendant, her employer since December 1996, is accused of different terms and conditions of employment because she sought benefits under Chapter 440.

The complaint details several instances of alleged discrimination including being moved from a window office to an inside office without windows in 2016, not receiving raises comparable to less tenured employees in Spring 2019, and learning about a non-disabled employee being given an office with a window view around the same time. The plaintiff's salary remained approximately $6,000 lower than that of another employee despite holding the same position and having a longer tenure.

Daphne Thomas is seeking damages individually in excess of Fifty Thousand Dollars ($50,000.00), exclusive of costs and interest. She claims that all conditions precedent to bringing this action have been satisfied.
