TAMPA — A man who builds websites and web applications is suing Tampa Bay Downs alleging it breached its contract with him.
Jennifer Viens and Austin Viens-DeRuisseau were also named as defendants in the suit.
Prabal Dey claims ownership of a computer software program, the "Fantasy Sports Code," registered with the U.S. Copyright Office, according to a complaint filed in U.S. District Court for the Middle District of Florida.
Dey claims he developed a fantasy sports website for the defendants, however, the defendants allegedly used the Fantasy Sports Code without permission, running it on a separate server platform and commercially exploiting it for financial gain to create fantasy sports websites.
The complaint points out that Viens, in collaboration with Tampa Bay Downs, managed the utilization of the fantasy sports code, with Viens-DeRuisseau overseeing technical aspects.
Despite entering into a contract with Dey for building the fantasy sports website and providing maintenance services, the defendants are accused of breaching the payment agreement.
The defendants have knowingly benefited from the unauthorized use of the fantasy sports code and the services provided by Dey, according to the suit.
Dey claims the defendants breached their contract with him.
Dey is seeking damages. He is represented by Derek P. Usman of The Usman Law Firm in Tampa.
