Friends accuse Morgan & Morgan of negligence in handling man's insurance claim

TALLAHASSEE — Two individuals are suing the country's largest plaintiff's firm for $45 million alleging it was negligent during a lawsuit.

Ronald Satish Emrit and James Lambert have been friends since 2008 or 2009, and Lambert retained Morgan & Morgan at some point thereafter to represent him in an insurance claim determination after he had been injured in a motor accident, according to a complaint filed on Nov. 15 in U.S. District Court for the Northern District of Florida.

In the pro se compalint, Emrit says Lambert's only sources of income are a divorce settlement and proceeds from motor accident insurance claims. He says Lambert is disabled because of injuries from motorcycle accidents.

The plaintiffs claim Morgan & Morgan took 40% of the insurance claim settlement, even though the firm allegedly was negligent in failing to inform the plaintiff that his attorney at the firm had passed away.

The firm also allegedly told Lambert not to seek treatment for his injuries and repeatedly would ask him if he'd lived in other states, which the plaintiffs allege was a breach of duty of competence, according to the suit.

"The plaintiffs argue that the rendering legal services is subject to a strict liability claim for the commission of manufacturing or design defect as products liability claim as opposed to the standard of negligence," the complaint states.

The plaintiffs are seeking compensatory, punitive and treble damages in the amount of $45 million.
