FT. LAUDERDALE — OL USA LLC is suing ShippingMyGoods.com alleging it failed to pay more than $20,000 for services rendered.
In October 2022, ShippingMyGoods enlisted the services of OL for non-vessel operating common carrier services, specifically arranging the transportation of household products from North America to various international destinations, according to a complaint filed Oct. 26 in U.S. District Court for the Southern District of Florida.
OL issued seaway bills of lading and invoices to the defendant for the services. The terms and conditions governing these services were outlined in standard form trading terms, explicitly incorporated into each invoice and bill of lading, and available on OL's website.
ShippingMyGoods failed to pay OL for the services rendered, according to the suit, despite receiving the goods and benefiting from OL's services.
OL sent a demand letter on June 28, requesting payment of outstanding invoices totaling $20,556.00.
ShippingMyGoods, however, has not fulfilled its payment obligations.
The plaintiff claims that the defendant's failure to pay constitutes a breach of the agreed-upon terms and conditions. It claims the defendant was unjustly enriched at the plaintiff's expense.
OL is seeking damages from the defendant, amounting to no less than $20,556.00, along with pre-judgment and post-judgment interest, costs and reasonable attorney fees.
