Parents sue pool manufacturer, property owners for drowning of daughter

ORLANDO – The parents of a child who drowned in a pool are suing for alleged negligence. 

Wismich Esperance and Betchine Amilcar, as co-personal representatives for the estate of Thamar Esperance, deceased minor, filed a lawsuit on Dec. 30 in the Orange County Circuit Court against Southern Paradise Pools and Spas, Carriage Hill Property Owners Association, Empire Management Group and Fence Direct for negligence.

According to the lawsuit, on Sept. 15, 2021, the deceased minor resided at a home neighboring the premises. Allegedly, she obtained access to an unsecured swimming pool and drowned. 

Plaintiffs allege that the defendants collectively were negligent in securing the pool, controlling the means of access and securing reasonable safety measures to protect the public from possible danger.

Plaintiffs were caused to suffer past and future mental pain and suffering, medical care and funeral arrangements, and other damages.

Plaintiffs seek a judgment in excess of judicial limits, cost of suit, interest and attorney's fees. Plaintiffs are represented by Michael a. Haggard of Coral Gables.
