Land Rover buyer sues, says he got a lemon

TAMPA - Donald Joseph Testa Jr. filed a complaint on October 18 in Hillsborough Circuit Court against Jaguar Land Rover North America, LLC for breach of written warranty pursuant to the Magnuson-Moss Warranty Act.

According to the complaint, Testa purchased a 2017 Land Rover Discovery on March 23, 2018. The price of the Discovery, including all collateral charges including registration charges, document fees, sales tax, bank charges and finance charges, totaled approximately $47,681.25. 

Testa alleges that as a result of the ineffective repair attempts made by the manufacturer through its authorized dealership network, the Discovery cannot be utilized for personal, family and/or household use as intended and that the manufacturer engaged in an aggressive advertising and marketing campaign in order to get Testa and other consumers to purchase its vehicles. 

Testa alleges that when he purchased the vehicle, it had defective electrical system, tires, wheels, axle system, climate control system and other defects. Testa alleges it is the fault of the defendant for selling the vehicle which was unusable and defective to Testa.

Testa seeks diminution of the value of the vehicle, consequential damages, cost of suit and attorney fees. Testa is represented by Bryan Arcila of Krohn and Moss, Ltd.
