Family sues for the disappearance and death of young woman

ORLANDO -- Marlon Marcano and Yma Su-Ling Scarbriel, as personal representatives of the estate of Miya Marcano, filed a complaint on October 18 in Orange County Circuit Court against Arden Villa Apartments, The Preiss Company and the Estate of Armando Caballero, deceased, for negligence, battery and vicarious liability.

According to the complaint, Miya Marcano began working for The Preiss Company on June 29, 2019, at the front office of Arden Villas where she was also a tenet. On Sept. 24, 2021, Marcano arrived at work around 1 p.m. and was scheduled until 5 p.m. to catch a flight with her family in Fort Lauderdale to attend the annual Miami Carnival, the suit says. 

Unknown to Marcano, Caballero used a key fob given to him by the Defendents to access Marcano's apartment, where he waited for her to get home. It is alleged that when Marcano got home, Caballero kidnapped her, which was not caught on camera as Arden Villa did not have security cameras. 

Marcano's family made multiple attempts to contact Marcano and Arden Villa with no response, the suit says. On September 26, 2021, Caballero was filmed by one of Miya's family members at the San Jose Apartment exiting his vehicle carrying gloves, a pink blanket, and a backpack. 

Caballero was found dead on Sept. 27, 2021 from a suspected suicide. Marcano's family alleges that Arden Villa Apartments are in part responsible due to lack of security, cameras, policies and procedures that could have saved Marcano's life.

Marcano and Scarbriel seek damages, interest, costs, and any further relief applicable by law. Marcano and Sarbriel are represented by Daryl K. Washington of Washington Law Firm, P.C.
