Lawsuit blames attorney for late man's property not making its way to children

TAMPA - Cynthia M. and Alvaro Andres Restrepo filed a complaint on October 13 in Hillsborough County Circuit Court against Gregory A. Sanoba, P.A. for negligence and vicarious liability. 

According to the complaint, on Dec. 14, 2006, Alvaro Andres Restrepo obtained Sanoba as his attorney for the services of creating a Last Will and Testament. As part of those services, Restrepo wanted to leave some of his estate to his children and some to his current wife. 

On Jan. 15, 2016, Alvaro Andres Restrepo again sought the advice of Sanoba in accordance to estate planning and transferring ownership of property to the children, which could not be executed unless Restrepo's former wife waived her rights to it. Sanoba should have known that but did not tell his client, which resulted in the property not being transferred, the suit says. 

Restrepo died on Jan. 5, 2021. The property was unable to transfer properly following his death because of the mistake that Sanoba made, the children and Cynthia allege. 

Cynthia Restrepo seeks compensatory damages, prejudgment interest and taxable costs. Cynthia Restrepo is represented by Michael McLaughlin.
