ORLANDO -- Multiple plaintiffs have brought suit against a medical care provider after a security breach leaked personal information.
Alma Lopez Morales, William Olivo, and Tanya Smalls, individually and on behalf of all others similarly situated, filed a class action complaint on September 16 in Orange County Circuit Court against Orlando Family Physicians, LLC for negligence, breach of contract and breach of fiduciary duty.
The complaint alleges that Orlando Family Physicians, LLC failed to secure personal information like dates of birth, demographic information and Social Security numbers, while health information including diagnosis, providers, prescription, medical records numbers, patient account numbers, health insurance information and claim numbers were also not safe.
Plaintiffs allege this information was kept for more than 100,000 patients, and this information was later accessed when the Orlando Family Physicians, LLC system was hacked on April 15, 2021, through an unauthorized actor accessing four email accounts of employees of Defendant through a "phishing" scam. Patients began being notified about the security breach on July 20, 2021.
Plaintiffs seek actual, consequential, and nominal damages, attorney's fees and cost of suit. Plaintiffs are represented by John A. Yanchunis.
