Ladder company sued after man falls, suffers traumatic brain injury

ORLANDO -- A couple are suing after the husband allegedly fell off a ladder and suffers a traumatic brain injury. 

Shawn and Nancy Lins filed a complaint on August 25 in Orange County Circuit Court against GPLogistics, Inc. for strict liability, negligence and loss of consortium. 

According to the complaint, Mr. and Mrs. Lins purchased an RV that included a GP SLD-D7 7" Double Sided A-Frame Ladder. On May 1, 2020, Mr. Lins was getting ready to repair a board on his patio cover. Mr. Lins needed to utilize the ladder because the patio cover is roughly eight feet tall. 

Mr. Lins placed the ladder on leveled pavers and ascended the ladder without issue, carrying a piece of wood and his drill to rest atop the patio cover and after descending the ladder without issue, Mr. Lins was preparing to climb back up, with nothing in hand to begin his repair project. 

On his second trip up, without warning, he suffered a catastrophic fall, despite utilizing the ladder in a normal manner because of the ladder's unreasonably dangerous and defective condition, the suit says. He fell head first into the concrete pavement, and sustained three fractures of his skull and multiple brain bleeds, was hospitalized for 26 days, and has continued to experience significant cognitive deficiencies from ongoing traumatic brain injury issues, the suit says.

The Linses seek pre-judgment interest, post-judgment interest, damages, cost of suit, other relief or equity. The Linses are represented by Harris I. Yegelwel.
