Woman sues apartment complex for man's murder

TALLAHASSEE -- A woman is suing an apartment complex after the father of her child was murdered. 

Naytoshia Smith, as the survivors of, on behalf and as personal representative of the estate of Javaris Miller, filed a complaint on August 25 in Leon County Circuit Court against New Griffin Apartments LP and Griffin Heights, LLC for negligence.

According to the complaint, on April 29, 2021, Miller was lawfully on the premises of Griffin Heights Apartments when he was allegedly brutally gunned down and murdered by a third party. Smith was pregnant with Miller's child at the time of the incident. 

Smith alleges the apartment complex did not ensure the safety of tenants, invitees and the public. Smith alleges that the apartments are neglectful in not taking proper action in preventing or providing property security to prevent a violent incident, despite knowing violent crimes had occurred on its premises and areas adjacent. 

Smith seeks damages in excess of $30,000, cost of suit and attorneys fees. Smith is represented by Matthew Williams.
