Lawsuit says apartment owner refused to correct mold issue

TAMPA -- A family is suing an apartment complex and development over for a mold infestation that allegedly resulted in a medical condition for a child. 

Jeffery Newman, Nicole Newman and S. Newman, a minor by and through her parent and guardian Jeffrey Newman, filed a complaint on September 3 in Hillsborough County Circuit Court against Fund Tuscany Ridge, LLC d.b.a Camden Visconti and Camden Development, Inc. for negligence and violation of Florida Statues 83.51.

According to the complaint, in August 2018, Jeffrey and Nicole Newman, with their child S. Newman, were tenants of Camden Development, Inc. Upon moving in, the Newmans noticed mold, the suit says, and the visible signs of mold returned multiple times throughout the tenancy despite repeated complaints to the property manager.

The Newmans allege the property manager and landlord refused to take proper steps to professionally test the property for mold, and they had to hire air quality assessors to professionally assess the Property.

Test results showed high levels of Aspergillus/Penicillium, the suit says. The Newmans notified the property manager and the landlord about the findings and moved out of the property the following day, the suit says. 

The Newmans allege that their child, S. Newman, suffered and will continue to suffer from mold exposure-related injuries including but not limited to persistent coughing, chronic runny nose, red and runny eyes, and respiratory difficulty. S. Newman was diagnosed with allergic rhinitis and linear atelectasis due to mold exposure, the suit says.
