Fight in school cafeteria leads to lawsuit

TAMPA -- Parents and their child are suing a school after the child was allegedly attacked by a known bully.

J.F., a minor, by and through his parents and natural guardians, Eric Foster and Stephanie Foster, filed a complaint on August 25 in Hillsborough County Circuit Court against North Tampa Christian Academy for negligence.

According to the complaint, on March 2, 2020, J.F. alleges that the school created a dangerous situation upon school property by failing properly supervise its students during lunchtime.

J.F. alleges that he, along with other children, were unsupervised in the school’s cafeteria when another child (who was a known bully) began harassing the students by swinging his lunch box around in an attempt to knock down the students. 

His behavior continued and was allowed to go on until J.F. attempted to protect himself and the other students; he grabbed the lunch box, which resulted in the bully directly attacking him, the suit says., 

J.F. was allegedly violently pushed to the ground by the bully and J.F.'s mouth came into contact with the hard cafeteria floor, the suit says. The impact was so severe that it resulted in J.F. cracking his two front teeth, the suit says.  

J.F. and his parents seek all liquidated damages, attorneys’ fees and cost of suit. J.F. and his parents are represented by Dawn. N. Jayma.
