ORLANDO -- A man is suing Walmart after a woman died allegedly due to the store not having a defibrillator handy.
Elijah J. Rivera, as personal representative of the estate of Lydia Rivera, filed a complaint on August 19 in Orange County Circuit Court against Walmart Inc. d.b.a Walmart Supercenter #3782 and Richard Mroczka for wrongful death.
According to the complaint, on October 29, 2019, Lydia Rivera was an employee of Walmart, when she collapsed to the ground and suffered a heart attack. It is alleged that Walmart did not have an Automated External Defibrillator at the location, or if it did, it was not retrieved and life-saving measures were not given to Lydia.
Rivera also alleges that Walmart failed to implement or suggest a training program that would ensure that an AED would be used and/or accessible, and/or to train the staff to understand a proper AED implementation procedure, and/or failed to ensure that the AED was placed in a location that was easily accessible.
Rivera seeks judgment for damages, plus costs and post-judgment interest. Rivera is represented by Spencer T. Kuvin.
