Man sues city for loose dirt after digging tree root

ORLANDO -- A man sues after alleging to have sustained injuries after dirt gave way from where Orlando had workers digging a tree root. 

Kenneth Lester filed a complaint on June 22 in Orange County Circuit Court against the City of Orlando, Orlando Utilities Commission and Haley Collins for negligence. 

According to the complaint, on June 7, 2020, Lester's property was struck by a tornado. On June 8, 2020, Orlando Utilities Commission and the City of Orlando responded to the area and dug around the tree roots of Haley Collins' property, but negligently failed to place caution tape around the area it dug. 

According to Lester, he walking on his property when the soil shifted and gave way due to the digging, and caused him to suffer injuries.

Lester is represented by Marcia Sampson.
