Business owner sues The Fresh Market over water leak, mold

TAMPA -- A couple are suing a store for a water leak and mold that allegedly resulted in their business being damaged and personal injuries from water and mold damage. 

Nikki Fraser and Anthony Leporino filed a complaint on July 8 in Hillsborough County Circuit Court against Flagship Studio Brands, LLC d/b/a/ Porte Noire, Wallace Enterprises, Inc. and The Fresh Market, Inc. for negligence and loss of consortium. 

According to the complaint, Fraser and Leporino were living next to The Fresh Market. In April 2017, The Fresh Market allegedly had a water leak it had known about, even requesting maintenance to address the leak and kill the resulting mold caused by the leak.

In 2018 or 2019, Fraser allegedly began feeling ill and fatigued causing her to seek medical treatment. On March 24, 2019, Fraser noticed in her salon that the baseboards were damaged and coming apart at the seams, and then brought the damage to the attention of Porte Noire, which inspected the building and found mold, the suit says. 

Fraser's business was moved, causing her economic damages, she says.
