Lawsuit filed over spoiled milk

TAMPA -- A man claims to have fallen violently ill after consuming milk and is suing over it.

Devan Cherry and Lintretha Hall filed a complaint on May 28 in Hillsborough County Circuit Court against 7-Eleven, Inc. and Borden Dairy Company of Florida, LLC for negligence.

According to the complaint, Devan Cherry and Lintretha Hall bought Borden Dairy whole milk at a 7-Eleven on October 5, 2020. Cherry and Hall allege that after consuming the milk, he immediately became violently ill and suffered severe cramping, nausea, diarrhea and vomiting and also sustained injury to his mouth, throat, stomach and digestive system. 

Cherry sought treatment and was diagnosed with food poisoning, the suit says. Cherry and Hall allege that 7-Eleven is responsible for selling a product that was not safe to consume. 

Cherry and Hall are represented by Jonathan I. Rotstein of the Law Office of Rotstein and Shiffman, LLP.
