Care center sued after man on feeding tube develops pneumonitis and dies

TALLAHASSEE -- A woman is suing a care center after a man died while in the facility's care.

Linda Williams, administrator of Xaiven Williams' estate, filed a complaint on June 1 in Leon County Circuit Court against Pensacola Care and Quest Management Group for statutory Chapter 415 violations and statutory violations under Chapter 393.

According to the complaint, Xaiven Williams was admitted into the care of Tallahassee Developmental Center (TDC) for care on August 6, 2019 and was totally dependent on the TDC care for daily living activities. 

During the time of his care, he was on a feeding tube and had strict restrictions for remaining elevated about 30 degrees for at least 45 minutes after being fed. On Nov. 20, 2019, Williams was fed around 8 p.m. and laid down soon after that. At approximately 2:25 a.m., staff found him clammy with watery eyes, difficulty breathing and with a cough, the suit says. 

EMS was summoned and Williams was taken to Capital Regional Medical Center, where he was found to be suffering from aspiration pneumonitis and acute respiratory failure with hypoxia. On June 22, 2020, Williams was scheduled to be fed at 9 a.m. and staff found him in his wheelchair with short and labored breaths, the suit says. 

EMS was called and arrived at 9:26 a.m. where they found him to be lethargic and cold to the touch and difficult to arouse. Williams was again taken to Capital Regional Medical Center where he went into cardiac arrest and died.
