Lawsuit: Hoverboard came to life, injured child

ORLANDO -- A parent claims in a recent lawsuit that his child was injured by a defective hoverboard. 

Jeremy Garrett, natural parent and legal guardian of minor R.M.G, filed a complaint on May 12 in Orange County Circuit Court against Razor USA LLC and Kohl's, Inc., for strict liability, negligence and breach of implied warranty of merchantability.

According to the complaint, Garrett purchased a Razor USA LLC "Hovertrax" hoverboard from Kohl's. On May 11, 2020, the hoverboard allegedly "was resting on the floor" and "malfunctioned and suddenly started moving without any user input." 

Garrett's child, minor subject R.M.G, was allegedly attracted to the lights and movement and reached for the hoverboard. Garrett alleged that the board continued to move and "R.M.G.s hand and fingers became entangled and trapped by one of the subject hoverboard's moving wheels" which continued to spin through the child's flesh. Garrett alleged this happened due to the board's "defective condition."

Garrett seeks damages for all injuries including actual damages, consequential damages, economic damages, non-economic damages, mental anguish, emotional distress, pain and suffering and cost of suit including interest. Garrett is represented by Steven E. Nauman of Morgan and Morgan P.A.
