TAMPA - A family is suing a woman for wrongful death, alleging their mother died from injuries sustained in a dog attack.
Danielle Smith, as Personal Representative for the Estate of Jane Perry Gervais filed a wrongful death suit on April 28 in Hillsborough County Circuit Court against Josephine White.
According to the complaint, Gervais was allegedly attacked by White's dog on September 22, 2020, while "lawfully on the sidewalk outside." A white and tan dog, owned by White, then without being provoked allegedly attacked Gervais, causing serious injury.
Gervais died on Jan. 4 as a direct result of injuries from the dog attack, the suit claims. Smith is joined with her siblings Joseph and Andrew Gervais in the suit against White.
Smith seeks judgment for damages, costs, prejudgment interest for that portion of the damages that have been previously liquidated. Smith is represented by Michael C. Bird of Morgan and Morgan Tampa, P.A.
