Lawsuit: Orlando restaurant server trips, drops hot pizza on customer's lap

ORLANDO — An Orlando restaurant is facing a negligence claim after a Pizza Hut server allegedly tripped and dropped a hot food item onto a customer's lap. 

Gianna Gonzalez filed a complaint April 26 in Orange County Circuit Court against Celebration Restaurant Group LLC alleging negligence. 

Gonzalez alleges in her complaint that on May 4, 2019, she was at the defendant's business located on Maguire Boulevard in Orlando. She claims that as she was served a hot pizza, the employee tripped and caused the food which "was above the safe handling temperature," to land in her lap. 

Gonzalez alleges she suffered injuries including disability, disfigurement and "permanent and significant" scarring as well as mental anguish. She also alleges she has incurred medical care costs as a result of the accident and makes claims for the defendant's negligence for failing to eliminate the "tripping hazard" and for serving food that was "over the safe temperature." Gonzalez further claims the defendant's employee negligently mishandled the food item. 

Gonzalez seeks monetary relief of more than $30,000, interest, trial by jury and all other just relief. She is represented by Daniel Benchimol of The Pendas Law Firm in Orlando.
