TAMPA - A Florida man is suing the Seminole Tribe of Florida alleging that the scale present in the room he occupied in their Tampa casino presented a dangerous condition.
The suit was filed May 6 by attorney John L. Mulvihill on behalf of plaintiff Frederick L. Snyder in Hillsborough County Circuit Court.
The suit alleges that the tribe “negligently allowed a dangerous condition to remain on their premises, a scale in the bathroom of its hotel suite,” and that the condition existed for a significant period of time, such that the tribe should have known of the dangerous condition.
The suit also alleges that the tribe was negligent in not alerting Snyder to the existence of the dangerous scale.
In addition, the suit alleges that Snyder requested a “handicap-accessible room” at check-in to the hotel, but that the tribe did not furnish him with such an accessible room. The suit alleges that Snyder being placed in a room that was not “handicap-accessible” caused him to slip and fall.
Snyder alleges that he “suffered bodily injury resulting in pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment, loss of earnings, and loss of the ability to earn money.”
Snyder is requesting a trial by jury and seeking damages in excess of $30,000, as well as costs.
